‍1.​ACCEPTANCE OF TERMS:

Bode, INC.  (together with its subsidiaries and affiliates, as used herein, “Bode”, “we”, “us”, and/or “our”) has published this website (the “Bode website”) to inform and provide a service to its users (as used herein, “User”, “Users”, “you”, and/or “your”).  Access to the Bode website may be revoked at any time by Bode.  By accessing the Bode website, Users agree to be bound by these Terms of Use (collectively, these “Terms”).   

2.​LIMITATIONS ON USE:

User may access, download, and print information from the Bode website for User’s personal and non-commercial use.  User shall not to interrupt, or attempt to interrupt, the operation of the Bode website in any way.  If Bode becomes aware of unlawful activity on its website, Bode reserves the right to notify appropriate authorities about such activity.

3.​LINKING:

The Bode website may contain links to other websites.  Any such links shall not be construed to be an endorsementby Bode of any products or services.  These Terms will also bind any Users who come to the Bode website through the links of others.  Bode is not responsible for any information or claims made by sites linking to Bode website.


4.SMS TERMS & CONDITIONS

  1. SMS Consent Communication: The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
  2. Types of SMS Communications: If you have consented to receive text messages from Bode Homes, you may receive messages related to the following:
    • Appointment reminders
    • Follow-up messages
    • Promotions or offers (if applicable)
      Example:
      Appointment reminder: “Your Bode Homes tour is confirmed for [date] at [time] at [location]. Complete the mandatory Home Tour Waiver Form before arrival. Questions? Call 786 -206-6201. Reply STOP to opt-out. ”

      Follow up: “Today is your Bode Homes tour at [time] at [location]. Click here to complete the mandatory Home Tour Waiver Form before arrival. Questions? Call 786 -206-6201. Reply STOP to opt-out.”

      Promotions or offers: “Limited Time Offer! [offer] rate. Move-in ready homes from [price] Call Now +1 844-466-9462 or Book Tour https://Bodehomes.zohobookings.com
  3. Message Frequency: Messaging frequency may vary depending on the type of communication.  For example, for promotional communication, you may receive up to 2 SMS messages per month.  For account communication, depending on where you are in your home purchasing process, you may receive anywhere between 2 to 20 messages per week relating to updates on a prospective home purchase or responses to questions you may have.
  4. Potential Fees for SMS Messaging: Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.
  5. Opt-In Method: You may opt-in to receive SMS messages from Bode Homes in the following ways:
    • Verbally, during a conversation
      • You can opt in to receive SMS messages from Bode Homes during conversations with the Bode Homes call center.
        • Example of opt-in language: “Would you like to receive the occasional text message related to information/promotions from Bode Homes? You can opt out anytime. If you’re interested, say YES, and we’ll send you a confirmation text.”
    • By submitting an online form
      • You may opt-in by filling out a book a tour form or the contact us form on the website and clicking on the checkboxes under the form.
      • Example of opt-in language:
        • By checking this box, you agree to receive text messages from Bode Homes. Reply STOP to opt-out at any time. Reply HELP for assistance. Message and data rates may apply. Message frequency will vary. Privacy Policy & T&Cs.
        • By checking this box, you agree to receive text messages and emails related to information/promotions from Bode Homes. You may reply STOP to opt out at any time. Reply HELP for assistance.     • By filling out a digital walk-in form
      • You may opt-in via a digital form when registering at the Bode Homes office or sales center.
        • Example of the opt-in language: By checking this box, you agree to receive text messages and emails related to information/promotions from Bode Homes. You may reply STOP to opt out at any time. Reply HELP for assistance. Message and data rates may apply. Message frequency may vary. For more information visit: Privacy Policy and T&Cs.
  6. Confirmation: A confirmation message will be sent after you opt in, confirming your subscription.
  7. Opt-Out Method: You can opt out of receiving SMS messages at any time. To do so, simply reply “STOP”, or similar keywords, to any SMS message you receive. And you will be automatically unsubscribed from the SMS subscription. Alternatively, you can contact us directly to request removal from our messaging list.

    In both cases, you will receive a confirmation message indicating that you will no longer receive SMS messages.
    • Example of opt-out confirmation SMS: You will no longer receive SMS messages from Bode Homes. To opt back in at any time, reply START.

7.​DISPUTE RESOLUTION:

Any disputes arising hereunder shall be submitted to binding arbitration and not to a court for determination.  Users of the Bode website, by virtue of User’s use and enjoyment of the Bode website, agree to the jurisdiction of Harris County and the State of Texas for any disputes arising hereunder.

8.​COPYRIGHT:

The materials on the Bode website are original copyrighted materials owned by Bode.  Any use, reproduction, or distribution of material from the Bode website without written permission of Bode is expressly prohibited.  No one may use the name “Bode, INC.”, “Bode HOMES”, or any derivation thereof without Bode’s prior consent.  

9.​DISCLAIMERS:

Use of the Bode website does not create any contract, agreement, legal rights, or obligations between User and Bode. User acknowledges and agrees that Bode does not warrant (i) the accuracy or completeness of text, graphics, links, or other information contained on the Bode website, (ii) that the website will not experience any service interruptions, or (iii) text or SMS communications sent by or on Bode’s behalf will not experience delays. To the fullest extent allowed by law, User waives any claim, demand or cause of action, against Bode or any of its personnel or service provided, relating to any purported damages incurred as a result of reliance on such information or any such service interruptions or delays. Pricing, floor plans, promotions, and other information contained on the Bode website are subject to change without notice. Offers and information shared by Bode Homes, and its partners are not guaranteed and can be cancelled, changed, or withdrawn without notice at the businesses’ discretion with no obligation. User acknowledges that any materials on the Bode website could contain typographical errors or misstatements. 10.​ENTIRE AGREEMENT:

These Terms set forth the entire agreement between Bode and User with respect to the subject matter hereof.  Any waiver of any provision of these Terms shall only be effective if in writing and duly signed by Bode.

Bode reserves the right to update these Terms at any time and without notice.  Any updates or amendments to these Terms will be found here.
